Compliance and licensing
At McCafferty Legal, we work day in, day out, within the key regulatory frameworks that govern the energy transition in Australia. Whether that is the National Electricity Law and Rules as they apply to facilities that are connected to the NEM, NEM participants navigating licensing requirements, or clients looking to understand and navigate Australian emissions accounting frameworks. Our detailed technical and commercial understanding of our clients’ needs allows our regulatory advice to be tailored for fit-for-purpose solutions that achieve our clients’ energy transition goals.
Increasingly our work is focused on advising on state-based energy regulatory frameworks such as the Electricity Infrastructure Investment Act (NSW) and the Energy (Renewable Transformation and Jobs) Act (Qld). Our nation-wide practice means we have experience working across all these state regulatory frameworks – in fact, we were involved in developing a lot of them.


Policy development
As well as advising on regulatory frameworks, McCafferty Legal advises clients on energy transition policy design and implementation. Our detailed knowledge of the energy market and project delivery allows us to support clients with a practical lens to policy design and implementation, and provide informed input to how the market will respond to proposed policy and legislative changes.
We are pleased to have had a role in the design and implementation of the renewable energy zone legislation in a number of jurisdictions of the NEM, and we look forward to continuing to support our clients to develop sound policy outcomes in support of the energy transition.

Access Frameworks
Aligned to our work on transmission and distribution construction, McCafferty Legal is a leading advisor on access frameworks for electricity infrastructure. Our firm has expensive experience advising on access frameworks, bringing together the legal, economic, commercial and technical aspects of developing complex shared linear electricity infrastructure. We have a strong understanding of the different access frameworks that exist, how they work, and how to apply those in a practical context.
